This User Agreement governs the use of the website, launcher, game servers, and related TERA: Phoenix services (the “Service”). The TERA: Phoenix Administration (the “Administration”) provides access to the Service under the conditions set out below.
By creating an account, installing the launcher, or continuing to use the Service, you confirm that you have read and accepted this Agreement. If you do not agree to its terms, stop using the Service.
1. General provisions
TERA: Phoenix is an unofficial fan project. It is not an official service of TERA's developer or publisher and does not act on their behalf.
This Agreement is supplemented by the Privacy Policy, Server Rules, and the terms of individual promotions or paid offers. In the event of a conflict, special terms apply only to the relevant feature or offer.
2. Account
An account is required to access certain features. Users must provide accurate information, keep their email address up to date, and not create an account in another person's name.
Users are responsible for safeguarding their login name, password, and access to their email, as well as for actions taken through their account. Any suspected account compromise must be reported immediately through the support section.
Selling, buying, transferring, and sharing accounts are prohibited unless the Administration expressly permits otherwise.
3. Age and legal capacity
The Service may be used by persons capable of accepting this Agreement under applicable law. Minors must obtain the consent of a parent or legal guardian where such consent is required.
A parent or legal guardian is responsible for a minor's use of the Service and related payments to the extent established by law.
4. License and intellectual property
Subject to compliance with this Agreement, users receive a limited, revocable, non-exclusive, non-transferable right to use the website, launcher, and available components of the Service solely for personal, non-commercial purposes.
TERA materials belong to their respective rights holders. The website design, software code, texts, and original TERA: Phoenix materials are protected under applicable law.
Copying, distributing, selling, modifying, circumventing technical restrictions, or analyzing the Service's software components is prohibited, except where expressly permitted by law or the Administration.
5. Operation and changes to the Service
The Service is provided “as is” and as available. The Administration may perform maintenance, update the client, and change game balance, available content, event schedules, and other game parameters.
The Administration aims to announce significant planned changes in advance but does not guarantee uninterrupted or error-free operation of the Service or the preservation of any particular feature, item, ranking, or game progress.
Users must use the current version of the launcher and comply with the published technical requirements.
6. Paid features
If paid digital goods or services are available in the Service, their price, contents, and delivery conditions are shown before payment is confirmed. Game items and internal currency are not legal tender and cannot be exchanged for money outside the options provided by the Service.
Payments may be processed by third-party payment providers. Refunds are handled in accordance with applicable law, the fulfillment status of the digital service, and the relevant provider's rules.
If you are charged in error or do not receive a purchase, contact support and provide the transaction identifier. Fraudulently disputing a payment that has already been fulfilled may result in account restrictions.
7. User conduct
Users must comply with the Server Rules, respect other participants, and not interfere with the normal operation of the Service.
In particular, the following are prohibited:
- cheats, bots, prohibited modifications, automation, and interference with network communications;
- exploiting bugs and vulnerabilities to gain an advantage or harm others;
- fraud, impersonating the Administration, and attempting to obtain other people's data;
- threats, harassment, discriminatory statements, spam, and publication of unlawful material;
- selling accounts, game currency, items, or services for real money outside the Service's official options.
8. Access restrictions
If the Agreement or Server Rules are violated, the Administration may remove prohibited content, reverse improperly obtained results, temporarily restrict features, or block an account. Measures are selected according to the nature, consequences, and recurrence of the violation.
The Administration may take urgent action without prior notice where necessary for the safety of the Service or other users. Decisions may be appealed through support under the procedure set out in the Server Rules.
9. Liability
Users use the Service at their own risk and must protect their own devices and data. The Administration is not responsible for connection interruptions, third-party actions, hardware incompatibility, or other circumstances beyond its reasonable control.
To the extent permitted by law, the Administration is not liable for indirect losses, lost profits, or loss of virtual assets. Nothing in this Agreement limits rights or liability that cannot be excluded under applicable law.
10. Changes to the terms and contact
The Administration may update the Agreement when the Service, security requirements, or legislation change. The new version is published on this page with its effective date. Continued use of the Service after an update constitutes acceptance of the new version.
Questions about the Agreement, requests, and complaints should be submitted through the support section on the website. Provide your account details and enough information to investigate the situation without disclosing your password.
